NEW MEXICO Statutes Annotated § 48-2-2.1 mandates that Subcontractors deliver by mail (Certified Mail highly recommended) or personally deliver a Notice Of Right To Claim a Lien to the Owner and the Prime/General
Contractor within sixty (60) days after the delivery of materials or beginning labor at a property as a prerequisite to enforcing a future Claim Of Lien. It is advisable that along with the Owner and the Prime/General Contractor
any other legal parties related to the improvement of the property (Customer,
Lender and other legal parties) get sent the Notice Of Right To Claim a Lien.

NEW MEXICO Statutes Annotated § 48-2-6 mandates that a Lien Claim should be filed by a General/Prime Contractor within one hundred twenty (120) days or Subcontractor no later than ninety (90) days after the completion of furnishing equipment, labor, materials or services for an improvement. It should be recorded with the clerk in the county where the improved property is located. The recorded lien should then be promptly mailed by certified mail or personally delivered to the improved property's Owner, Agent or Trustee along with other legal parties for the project (General/Prime Contractor, Lender/Surety, Customer).
