A Notice To Contractor By Subcontractor's Materialman may be given to a General Contractor by a Materialman who is a 2nd tier contractor, or Subcontractor of a Subcontractor. It informs the Contractor that a material supplier to a Subcontractor who may be previously unknown to the Contractor could be filing a claim if prompt payment is not received.

Montana Code Annotated § 71-3-532 mandates that a Notice Of The Right To Claim A Lien must be served to all legal parties
on a project (Customer, Owner, General Contractor, Lender) within 20 days
after first furnishing construction related labor, services, equipment
or materials. Each day after the 20th day, you lose 1/20 of your financial
interest in the financial value of construction related labor, services,
equipment or materials your company provided for the project. A Notice Of The Right To Claim A Lien may be given out at a later point in time, but your financial recovery
for a Mechanic's Lien, if filed, can only be for the 20 day period prior
to the Notice Of The Right To Claim A Lien being filed.

Montana Code Annotated § 71-3-536 mandates that you
must file a Mechanic's Lien Statement with the County Recorders Office
in the County where the project occurred. It must be filed within 90
days after a Notice Of Completion is filed or the completion of providing labor, rental equipment, or materials for the project.
After recording, a copy should be delivered in person or by Certified Mail to the Owner
of the property along with any other legal parties related to the improvement
of the property (Customer, Lender, General Contractor).
