Preliminary
Notice (Residential Projects) |
INDIANA Code § 32-8-3-1 mandates that on residential projects a Preliminary Notice must be served by the Subcontractor who is in contract with someone other than the Owner (General/Prime Contractor, another Subcontractor) to the owner of a owner-occupied improvement within thirty (30) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. It must be delivered in person, or by Certified Mail, to the Owner of the property. It is advisable that along with the owner any other legal parties related to the improvement of the property (Owner, Customer, Lender and General Contractor) get sent the Preliminary Notice.
If the residential project is new construction of a family dwelling, the Preliminary Notice within sixty (60) days after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. It must be delivered in person, or by Certified Mail, to the Owner of the property. It is advisable that along with the owner any other legal parties related to the improvement of the property (Owner, Customer, Lender and General Contractor) get sent the Preliminary Notice. It must also get recorded within the same time period at the County Recorder's office in the county where the project originates.

in the County where the project occurred. It must be filed within sixty (60)
days (commercial) or ninety (90) days (public improvements, commercial) after the completion of providing labor, rental equipment, or materials.
A recorded copy should also be delivered in person or by Certified Mail to the Owner
of the property along with any other legal parties related to the improvement
of the property (Customer, Lender, General Contractor).

A notarized Release Of Intention To Hold Mechanic's Lien is used if you are paid in full for a previously recorded Mechanic's Lien. File it at the Recorder's Office in the Recording District/County where your work of improvement occurred. Send copies after it is recorded to all the legal parties for the project.

Stop Notice (Private Project) |
INDIANA Code § 32-8-3-9 mandates that a Stop Notice can be served by the Subcontractor who is in contract with someone other than the Owner (General/Prime Contractor, another Subcontractor) to the Lender/Surety/Owner along with the General/Prime Contractor after first furnishing construction related labor, professional services, materials, machinery, fixtures or tools to a jobsite. This is not a lien, it does not have to be recorded like a lien at the County Recorder's office. It also can be sent to the legal parties on a project at any time while funds are still available to be disbursed to the General/Prime Contractor.
A Stop Notice does request that the Lender/Surety/Owner stop disbursing funds to the General/Prime contractor before all money is disbursed. A notarized copy should be delivered in person, or by Certified Mail, to all legal parties related to the improvement of the property (Owner, Customer, Lender and General/Prime Contractor). |

Verified Claim On Bond (Public Project) |
INDIANA Code § 32-8-3-1 mandates that on Public projects a Verified Claim On Bond is used by Subcontractors . It must be filed with the Public Authority (city, county, authority) and delivered to the Lender/Surety within sixty (60) days that equipment, labor, materials or services was provided for the Public improvement.
Subcontractors may not file suit against the bond against the Lender/Surety on the General/Prime Contractor's bond until thirty (30) days after filing of the Verified Claim On Bond with the Public Authority.
